Employment Law Updates for 2023

Update your Severance and Release agreements:  If your separation agreement contains a non-disparagement clause, make sure that it also states: "Nothing in this Agreement prevents you from discussing or disclosing information about unlawful acts in the workplace, such as harassment or discrimination or any other conduct that you have reason to believe is unlawful."

Update Your Employee Handbooks and Leave Policy:  Employees can now take California family leave and sick time for not just family but also one "designated person" 

PAGA Arbitration Agreements.  While the California Supreme Court settled that individual PAGA claims are subject to enforceable arbitration agreements, the Plaintiff's bar and Appellate courts will battle it out over whether the remaining aggreieved employee claims proceed in court.
